Welcome to the Terms of Service of MyDilSong, operated by TH INNOVATION LABS LTDA, registered under CNPJ 51.673.852/0001-80, headquartered at Avenida Professor José Ignacio de Sousa, 1186 Sala 10, Uberlândia, Brasil. By using our service, you agree to these terms. Please read them carefully.

Important summary: We create personalized songs according to your specifications with delivery within a maximum of 8 hours. Immediately after payment, you will be able to view the production status of your order in real time. We allow up to 2 adjustments to the chorus. As this is a custom digital product, created exclusively according to your instructions, the right of withdrawal does not apply once production has begun (Art. 49, §1° of the CDC and Art. 16, II of the LGPD).

1. Definitions

For the purposes of these Terms:

  • "Company" refers to TH INNOVATION LABS LTDA (CNPJ: 51.673.852/0001-80), operating under the brand MyDilSong.
  • "Service" refers to the creation of personalized songs offered by MyDilSong.
  • "Client" refers to you, the person contracting our services.
  • "Personalized Song" refers to the musical work created exclusively for you based on the information provided.

2. Our Services

2.1 Creation process

We produce the song according to your specifications and may adjust the chorus up to 2 times, if requested within 7 days of the initial delivery. Significant changes to the lyrics or melody after approval may be subject to additional costs.

2.2 Delivery timelines

Your personalized song will be delivered within a maximum of 8 hours after payment confirmation. Immediately after payment, you will have access to a tracking page where you can view the production status of your order in real time.

3. Payments

3.1 Pricing and payment

Prices are displayed in the currency corresponding to your region and may include applicable taxes in accordance with local legislation. Payment is made in full when contracting the service through authorized third-party payment platforms (such as Hotmart, Stripe, or other payment processors). MyDilSong does not store credit card data or sensitive financial information.

3.2 Right of withdrawal

In accordance with Art. 49 of the Brazilian Consumer Defense Code, you have the right to withdraw from the purchase within 7 days of contracting. However, as this is a custom digital product, created exclusively and uniquely according to your specifications, this right does not apply once production has begun, as the product cannot be reused or resold.

  • Before the start of production: full refund of 100% of the amount paid.
  • After the start of production: no refunds will be issued, given the personalized and unique nature of the product.

3.3 Satisfaction guarantee

We are committed to delivering a quality product. If you are not satisfied with the result, we offer up to 2 free adjustments to the chorus within 7 days of delivery. If, after the adjustments, any issue with the delivered product persists, we will evaluate your case individually to find a satisfactory solution. 3.4 Dispute resolution

In the event of a disagreement, we ask that you contact us first through our support channels before initiating any dispute with the payment processor. We commit to responding within a maximum of 48 hours and to seeking a fair solution for both parties.

4. Copyright and Intellectual Property

4.1 Transfer of rights

Once payment is completed, the copyright of the created song is transferred to you, except for the reproduction and commercial distribution rights retained by MyDilSong for promotional purposes.

4.2 Use of the song

You may use the personalized song for personal purposes, as a gift, or at events. For commercial use (for example, in products or advertising campaigns), please contact us to discuss additional licensing.

5. Client Responsibilities

5.1 Information provided

You agree to provide accurate and complete information about the person being honored, the relationship, and the feelings you wish to express in the song. We are not responsible for inappropriate or inaccurate content resulting from incorrect information provided by you.

5.2 Reviews and approvals

It is your responsibility to review the lyrics and the musical proposal and to request adjustments within the established timeframe (7 days after delivery). After this period, we will consider the work as approved.

6. Limitation of Liability

MyDilSong shall not be liable for:

  • Any misuse of the personalized song by the Client or third parties.
  • Indirect, incidental, or consequential damages arising from the use of the service.
  • Negative emotional reactions from the recipient of the song.
  • Delivery delays caused by factors beyond our control.

7. Modifications to the Terms

We reserve the right to modify these Terms at any time. The most recent version will always be available on our website. Continued use of the service after such modifications constitutes your acceptance of the new Terms.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, in particular the Consumer Defense Code (Law 8.078/1990) and the General Data Protection Law (Law 13.709/2018 — LGPD). Any dispute related to these Terms shall be submitted to the jurisdiction of the district of Uberlândia, state of Minas Gerais, Brasil, without prejudice to the consumer's right to choose the jurisdiction of their domicile.
